FAQs

What does “uncontested” divorce mean when children are involved?

Uncontested means the parties that are anticipating getting a divorce can discuss and decide on the better interest of the children without a court order.  If you anticipate complex issues in your divorce action, seeking legal advice is strongly recommended.

What do i do if i am anticipating matrimonial property issues?

I do not handle cases where the divorcing parties own their own house, business, property, or assets that will need to be divided during the divorce proceeding. Legal advice is required.

Why is a will important?

Your loved ones may be responsible to finalize your estate after your death.  The process is so much easier for those left behind if everyone is aware of your wishes.  Without a will, the legislation decides how and to whom your estate is disbursed.

How can you assist in civil law suits?

Currently, I only assist in inputting your information in court documents that may be required during your court proceedings, ie:  affidavits, applications, etc.  I do not assist in Civil Claims law suits in the Alberta Court of Justice, nor commencing any law suits in Court of King’s Bench.

Where is your office located?

At this current time, I am a mobile unit serving Medicine Hat and area, where I go to the customer.  If meeting at your residence is not doable, a public meeting place will be arranged as agreed.  Most initial meetings are conducted via telephone.

Can you appear in court for me?

No, this service is outside my area of expertise.

Are you able to assist in Probate applications or applications for Letters of Administration in Court of King’s Bench?

Yes, I can assist in those areas by inputting your information in the required forms.  Complex estates or estates where you anticipate a dispute or objection, will require the assistance of a lawyer.

Are you limited to courts in Alberta?

Yes, as the legislation and process differs in every province.  My area of expertise is Alberta only.

Can Your Paralegal Assist help with criminal matters?

No, unfortunately, I do not have the expertise in that area of the law.

Are you a lawyer, a barrister or a solicitor?

No, I am a paralegal only.  I cannot give legal advice.  I can assist if you are struggling to maneuver and complete forms in the Alberta legal system limited to the areas of surrogate court, or family law/divorce court.
